The agreement between you, your shop and us

Plain terms for using Korat. If something here conflicts with what the app tells you at the time, tell us — that is a bug in one of the two.

By using Korat you agree to these terms. They apply to the Android app, the web app at koratland.com/app, and this website. Version 3.0.

1. What Korat is — and what it is not

Korat is a venue and a set of tools. It is the place where people talk, post and form groups, and where a shop publishes a page, a menu, prices, opening hours and stock — plus the tools that let a transaction happen: a table QR, an order form, a booking form, a kitchen display, a bill, a receipt.

What Korat is not is three things, and all three are literally true rather than defensive wording.

  • Not a party to the sale. The contract of sale, hire, lodging or service is between the customer and the shop. Korat is not the seller, not the buyer, not an agent of either, and not a guarantor of either.
  • Not in custody of the goods. Korat never holds, ships, stores, inspects or handles anything sold through it. There is no Korat warehouse and no Korat courier.
  • Not holding the money. Korat does not accept card payments, does not operate an escrow, does not hold a float and does not take a cut at the point of sale. Payment is direct between customer and shop — cash, transfer or PromptPay into the shop's own account. A shop's PromptPay ID is the shop's; we display it and do nothing else with it.

Section 9 rests on those three. If any of them ever stops being true, section 9 must be rewritten the same day.

Our age check is three-valued, not two: ok / under age / unknown. An unknown birth date is not treated as adult. The only exit from "unknown" is a member of the shop's staff checking an identity document at the table, which is recorded with who checked and when. There is no exit from "under age".

You are responsible for access to your own account. Use a password you use nowhere else, and add a passkey where you can. If you see a sign-in you do not recognise, revoke that device in Settings and change your password. Write to hello@koratland.com if you believe an account has been taken over. You may not sell, rent or transfer an account.

3. Acceptable use

Use Korat lawfully and in good faith. Content has to pass two tests: it must be lawful where you are and where the person you are dealing with is, and it must clear the floor below — which is prohibited on Korat whatever local law says.

  • Harming or exploiting children. No sexual content involving anyone under 18, in any form, real or synthetic. No grooming. This is reported to the authorities, not merely removed (Criminal Code s.287/1 and s.287/2).
  • Trafficking in people. No recruitment, transport, harbouring or receipt of a person for exploitation, by any means — including debt bondage, forced labour, and a "job offer" whose real subject is a person's freedom (Anti-Trafficking in Persons Act B.E. 2551, s.6 — an offence even where the victim initially consented).
  • Sexual services, or arranging them. See section 4.
  • Narcotics and controlled substances, including precursors and paraphernalia (Narcotics Code B.E. 2564).
  • Inciting hatred or violence. No content that attacks, dehumanises or calls for violence or exclusion against a person or group by race, ethnicity, national origin, religion, disability, disease, sex, gender identity or sexual orientation. Criticism of ideas, institutions, policies and businesses is not this and is not restricted.
  • Threats, harassment and stalking. No threats of violence, no sustained unwanted contact, no coordinated pile-ons, and no doxxing — publishing another person's home address, identity document, phone number, workplace or location without their consent.
  • Sexual content of an adult published without consent, including synthetic depictions of a real identifiable person.
  • Gratuitous violence. No content whose purpose is to display killing, torture or serious injury for shock, and no glorification of a person who committed a mass atrocity. Documentary, journalistic and medical context is not this.
  • Promoting self-harm. No encouragement of suicide, self-injury or eating disorders, and no instructions for them.
  • Impersonation of a person, business or public authority. A parody or fan account must say what it is, where it is.
  • Fraud — fake listings, advance-fee schemes, phishing, pyramid and MLM recruitment, fake reviews, counterfeit goods.
  • Gambling in every form, including promoting or soliciting it (see section 4).
  • Spam — bulk unsolicited messaging, automated mass friend or match requests, engagement farming, scraping.
  • Attacking the service — accessing data that is not yours, probing or circumventing access controls, reverse engineering, interfering with availability, or automated access outside a published API.
  • Breaching Thailand's speech-adjacent criminal law — defamation (Criminal Code s.326–328), dissemination of false computer data causing damage (Computer-Related Crime Act B.E. 2550, s.14), and s.112.

We deliberately do not use "immoral" as the operative standard. It cannot be applied consistently across ten languages and a dozen countries, and a rule nobody can apply predictably is enforced arbitrarily. What it was meant to cover is written out concretely above instead.

4. Prohibited goods and services

4.1 The core list — prohibited on Korat everywhere

Whether or not it is lawful where you are, you may not list, sell, advertise, solicit or arrange any of the following through Korat.

  • Human beings, or any transaction whose subject is a person's freedom or labour under coercion.
  • Sexual services, and the arranging or advertising of them — prohibited in every country, including countries where sex work is lawful and licensed, because Korat has no mechanism at all to tell a consenting licensed worker from a trafficked one, and the cost of being wrong is not symmetrical in the two directions.
  • Narcotics, controlled substances, precursors and paraphernalia.
  • Weapons, ammunition, explosives and their components (Firearms Act B.E. 2490).
  • Stolen goods, and goods obtained by fraud.
  • Counterfeit goods and goods infringing a trade mark or copyright (Trademark Act B.E. 2534, Copyright Act B.E. 2537; importing counterfeits is separately an offence under the Customs Act B.E. 2560, s.246).
  • Smuggled and untaxed goods — anything that has not passed customs, and any excisable product (alcohol, tobacco, fuel, some beverages) without the duty paid and the stamp affixed. Customs Act B.E. 2560 s.242 carries a fine of four times the price of the goods including duty and/or up to 10 years' imprisonment, plus forfeiture.
  • Protected wildlife, their parts and products, and protected plants (Wild Animal Conservation and Protection Act B.E. 2562, and CITES).
  • Human tissue, organs, blood and gametes.
  • Sexual content involving anyone under 18, in any form.
  • Gambling, lotteries and games of chance, and promoting, advertising or facilitating them (Gambling Act B.E. 2478 — organising and participating are both offences, and online gambling through any platform, including offshore sites, is illegal).
  • Personal data offered as a product — lists, scraped databases, credentials, identity documents.
  • Prescription-only medicines, and medicines sold outside the licensing regime (Drug Act B.E. 2510).
  • Financial instruments, digital assets, money transmission and lending, unless the shop holds the licence its own regulator requires and shows it.
  • Any service whose purpose is to break the law or these terms — hacking, forged documents, paid reviews, exam sitting, visa fraud.

4.2 The annex list — it depends which country the shop is in

Some categories are lawful in one country and criminal in another. E-cigarettes are prohibited to import and to sell in Thailand but are ordinary regulated retail in most of Europe. Sex toys fall under the Thai obscene-objects provision but are ordinary retail in Japan and Germany. One global list is therefore wrong in both directions at once — too strict and it bans lawful trade, too loose and it reads as permission to commit a crime.

Those categories live in country annexes, and what applies to a shop is the annex for the country the shop operates in: e-cigarettes and heated tobacco, sex toys, adult content, tobacco, alcohol, cannabis and CBD, knives and self-defence items, herbal products and supplements, firearms parts and replicas, live animals, and gambling-adjacent equipment.

Where no annex exists for a country, everything in 4.2 is prohibited there in full. A default of "allowed" would mean the first shop in an unlisted country is the one who finds out the hard way what is a crime. Thailand is the only annex that exists today.

4.3 Annex TH — Thailand, in summary

Additionally prohibited: e-cigarettes, vaping devices, e-liquid and heated tobacco of every kind (import banned by Ministry of Commerce notification 2014 and under the Customs Act; sale banned by Consumer Protection Board Order 9/2558, replaced in 2024 by Committee on Safety of Products and Services Decree 24/2024) · sex toys and obscene objects (Criminal Code s.287 — three to seven years' imprisonment and a fine of THB 60,000–140,000) · pornography · sexual services · all gambling · all tobacco products · cannabis · firearms · protected wildlife · untaxed and smuggled goods.

Permitted with conditions: alcohol — an excise licence number recorded on the business page; sale only between 11:00–14:00 and 17:00–24:00; no sale on the statutory Buddhist holy days; buyer 20+; and no sales promotion of any kind — an alcoholic item can never show a discount, a struck-through price or a percentage badge anywhere on the platform (Alcohol Beverage Control Act B.E. 2551 s.32, as amended by Act No. 2 B.E. 2568, in force 8 November 2025). The trading-hours exemption is granted by a Korat administrator, never by the shop — an exemption the beneficiary can grant itself is not an exemption. Entertainment venues admit nobody under 20 at all. Food service: Public Health Act B.E. 2535. Accommodation: Hotel Act B.E. 2547. Supplements and herbal products: FDA registration.

5. Content you post

What you post stays yours. You grant Korat a non-exclusive, royalty-free licence to store, transmit, reproduce and display it only to the extent needed to run the service for the audience you chose — public, friends, a group, one chat — and for no other purpose. The licence is not sub-licensable, and there are no advertisers or data brokers to sub-license it to anyway.

The licence ends when you delete the content, save for copies in operational backups until they rotate out, and copies other users lawfully received, which we cannot recall — a message you sent is in the recipient's chat. Leaving a group does not delete what you wrote in it.

Everything you see from another user or a shop — a post, a photo, a menu, a price, a review, a claim about a product — is theirs, not Korat's. We do not pre-screen it, do not verify it, and do not endorse it.

6. If you open a shop on Korat

You are the seller. Korat is not. You are the counterparty to your customer for everything: the goods, the service, the room, the appointment, the price, the delivery, the refund and the complaint.

  • Accuracy — your page, menu, product descriptions, prices, stock, options, opening hours, delivery area, delivery fee and photographs are yours to get right. A price shown is a price you must honour for an order placed against it.
  • Licences and compliance — you must hold and keep current every licence your business needs, and comply with every law that applies to it: food safety, an excise licence for alcohol, accommodation registration, professional licences, labelling, price display. Korat's own controls are a floor, not a substitute, and are not legal advice about your business.
  • Prohibited goods — section 4 applies to you in full, including the annex for your country.
  • Tax and receipts — VAT, income tax, withholding, and issuing a receipt or tax invoice are yours. Korat's bill and receipt screens are a record of the transaction and are not a tax invoice unless you have configured them to be and are entitled to issue one.
  • Payment — direct between you and your customer. Korat does not hold funds, does not settle, does not refund and cannot reverse anything. Any refund is yours to make.
  • Staff — you are the employer. What your staff do in the business console is your responsibility, including an age check at a table, which records who checked precisely so that it has an owner.

For the customer data you collect through the console, you are a data controller in your own right — not our processor. The PDPA's obligations fall on you directly: a lawful basis (s.24), a notice to your customers (s.23), security measures (s.37), honouring their rights (s.30–36), breach notification within 72 hours (s.37(4)), and a DPO if you process more than 100,000 records as a core activity (s.41). Administrative fines reach THB 5 million per contravention (s.83). And you may not add a customer to your own marketing list because they ordered from you.

7. Reviews

Only a customer whose transaction the platform can prove may write a review, and the star rating is computed from those reviews automatically. We do not edit or remove a review because a shop dislikes it; we do remove reviews that breach section 3. A shop may reply to any review publicly. Buying, exchanging, incentivising or writing reviews of your own business breaches section 3 and costs you the page.

8. Reporting and enforcement

You can report a profile, a post, a comment or a story; anything involving a child goes through the child safety standards page instead. Reports go to a queue a human reads. There are three outcomes and they are kept apart: actioned / reviewed, nothing wrong / nobody has looked yet — because "we looked and it was fine" and "nobody has looked" are different answers, and deleting dismissed reports makes a person who is being reported vindictively invisible.

Content that breaches sections 3 or 4 is hidden, not deleted. Hidden content disappears for everyone including its author — a post still visible to its author but to nobody else is an accidental shadow-ban — and the author is notified with the reason.

We may suspend or terminate an account that breaches these terms. Suspension means you cannot speak, not that your data is gone — you keep read access to your own account, the suspension carries a reason, and where it is time-limited it expires by itself. We say which rule was broken, except where saying so would obstruct a criminal investigation.

9. Limitation of liability

Under the Unfair Contract Terms Act B.E. 2540, a term excluding or restricting liability — including a notice or announcement, not only a signed contract — is enforceable only to the extent that it is fair and reasonable in the circumstances, and a court cuts it down to that extent. The practical consequence is the opposite of the instinct: "we are not liable for anything" is worse than a narrow clause, because the court reduces the whole provision rather than the sentence that went too far. So this one is written narrowly, and anchored to the facts in section 1.

Korat is not responsible for the quality, safety, legality, description, fitness or availability of anything a shop or user sells, lets, serves or provides · the accuracy or legality of content a user or shop posts · the performance of the contract between a customer and a shop, including non-delivery, a wrong order, a refused refund or a cancelled booking · or what happens when people meet, whether through Dating, through a group, at a table, or at a delivery door. Use your judgement, especially when meeting or paying a stranger.

What we do not attempt to exclude, and will not — liability for death or personal injury caused by Korat's own negligence · Korat's own fraud or wilful misconduct · Korat's own gross negligence · and anything Thai law does not permit to be excluded, including a consumer's rights under the Consumer Protection Act B.E. 2522 and the Liability for Damage Arising from Unsafe Products Act B.E. 2551 against the party that actually supplied the product. Wording that purports to exclude those is not merely ineffective — it is what makes a court reach for the Unfair Contract Terms Act and cut down the rest with it.

We do not promise uninterrupted availability, and — as the security page says — there is currently no database backup on the hosting plan in use. Keep your own copy of anything you cannot afford to lose.

10. Ending it

You may stop using Korat at any time, and request deletion of your data at privacy@koratland.com. We may suspend or terminate an account that breaches these terms, per section 8.

11. Changes

These terms may change. A material change is announced in the app and dated here. Continuing to use Korat after a change takes effect means you accept the new version.

12. Law, language and annexes

These terms are governed by the law of Thailand and the Thai courts have jurisdiction. Where you are a consumer resident elsewhere, this does not remove protections your own country's law gives you that cannot be contracted out of. If any provision is unenforceable it is reduced to the extent that makes it enforceable, or severed if it cannot be, and the rest stands.

The Thai text is the only authoritative version. The other nine languages — English, Chinese, Japanese, Korean, Spanish, German, Russian, French, Arabic — are provided for convenience and have no independent legal effect. Where they conflict or are ambiguous, the Thai text governs. Without that clause a single mistranslation becomes a binding term.
